Terms of Service
Last updated: September 27, 2026
These terms apply when you order work from İyikare ("we", "us", "the studio"). Each project is also confirmed by email before work starts — that written confirmation, covering scope, price and delivery date, sits alongside these terms and takes precedence where the two differ.
1. What we are, and what we are not
İyikare is a marketing production studio. We are not a licensed real estate brokerage, and we are not licensed real estate, legal, tax or financial advisors. We do not list, market on your behalf as an agent, represent buyers or sellers, advise on price, negotiate, or take any part in a transaction. We produce images, video, written copy and web pages that you, the licensed professional, decide how to use.
Every representation you publish remains yours. You are responsible for compliance with your state real estate commission's advertising rules, your MLS's rules, and your brokerage's policy.
2. Services and scope
We work entirely remotely. We do not visit properties and we do not photograph or film on site. Every deliverable is produced from material you supply.
The specific deliverables, quantities, formats and revision rounds for your order are those listed on the package you selected and restated in your written confirmation. Anything not listed is out of scope. If you want something added, we will quote it before doing it — you will never receive a bill for work you did not approve.
3. Rights in the material you send us — read this one
This is the clause that most often causes trouble in real estate, so we state it directly.
In the United States, the copyright in a property photograph normally belongs to the photographer who took it — not to the listing agent, not to the seller, and not to the MLS. An agent typically holds a license to use the image for that listing, and that license often does not include the right to create edited or derivative versions.
By sending us material, you confirm that:
- you own it, or you hold a license that permits editing and derivative works;
- you have the property owner's permission for the work you are asking us to do; and
- you will indemnify us against claims arising from material you did not have the right to send.
If you are unsure who owns your listing photographs, ask your photographer before ordering. It is a short conversation, and it is far cheaper than the alternative. We would rather turn down a job than produce work you cannot legally publish.
4. Rights in what we deliver
On full payment, you may use the delivered files to market the property they show and to promote your own real estate business, on any platform and with no time limit. You may share them with your seller and your brokerage for the same purposes. This covers the parts we created. Rights in the source photographs stay with their owner, and licensed music in a video is covered for use with that video only.
We show work in our own portfolio and marketing only with your written permission. If you give permission and later withdraw it, we remove the work.
5. Digitally altered images and your disclosure obligation
Virtual staging, day-to-dusk conversion, item removal and virtual renovation all produce images that do not depict the property's current condition.
What we do:
- every altered image is delivered with a visible on-image disclosure label;
- the untouched original is delivered alongside every edit;
- we supply the disclosure sentence for you to enter in your MLS public remarks;
- we do not alter anything structural — we do not remove walls, conceal damage or defects, or imply space that does not exist. Staging shows potential. It must never misrepresent condition.
What only you can do: enter the disclosure in the MLS, keep the labels intact when you publish, and meet any additional requirement of your state. Rules differ and continue to change — California, for example, requires a conspicuous disclosure adjacent to the image plus a link or QR code to the unaltered original. Removing our labels, or publishing an altered image without disclosure, is outside these terms and is your responsibility alone.
6. Fair Housing
Listing copy and imagery are subject to the Fair Housing Act. We will not write copy or produce imagery that references, or signals a preference based on, race, color, religion, sex, national origin, familial status or disability. If you ask us to change copy in a direction we believe creates Fair Housing exposure, we will tell you and decline that specific change. Final published wording, as always, remains your responsibility.
7. Pricing, payment and turnaround
- Prices are in US dollars, fixed per listing. No hourly billing, no per-image surcharges.
- 50% to begin, 50% on final delivery, unless your confirmation says otherwise.
- Published turnaround times refer to the first draft. They run from the moment the brief and all required material are received and approved — not from the moment you order. Revision rounds follow your feedback. A 24-hour rush first draft is available for Vacant Listing Staging and Launch Day at +$99, subject to capacity and confirmed before you order.
- If we miss a confirmed delivery date for reasons within our control, you may cancel and receive a full refund of amounts paid for that order.
8. Revisions, cancellation and refunds
Your package includes a stated number of revision rounds. Additional rounds are charged at $45 per round ($65 for Atelier), and we confirm the price in writing before any additional work starts. A revision means refining the work delivered against the brief; a change of brief is a new order. Production errors — a defect we introduced, such as a distorted line or an incorrect reflection — are corrected at no charge and do not use a revision round.
- Cancel before production starts: full refund.
- Cancel during production: the deposit covers work completed to that point and is not refundable; nothing further is owed.
- After final delivery: no refund, but we will keep working through your included revisions.
9. What we do not promise
We produce presentation. We do not promise that a property will sell, sell faster, sell for more, or attract any particular level of interest. Any figures we cite in our marketing are general industry information, not a prediction about your listing.
10. Liability
To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost commission, lost sales or lost opportunity.
11. Confidentiality
Off-market and pre-launch listings are treated as confidential. We will not publish, show or discuss them — including in our own portfolio — until you tell us the listing is public, or you give us permission.
12. Governing law and disputes
İyikare operates from Türkiye and delivers remotely. These terms, and any dispute arising from them or from an order, are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. The courts and enforcement offices of İstanbul, Türkiye have exclusive jurisdiction.
Before filing anything, email us. Nearly every disagreement in this line of work is a scope misunderstanding and is settled the same day. Any claim is brought individually and not as a class, collective or representative action.
13. Changes to these terms
These terms may be updated; the version in force is the one published on this page when you place your order, and we will keep the date at the top current. Material changes are communicated to active clients by email.
